🚫 Kratom is illegal in Alabama as of May 2016. Kratom is categorized as a Schedule I controlled substance. The American Kratom Association is working with lobbyists to replace the ban with the Kratom Consumer Protection Act.

Kratom is legal in New Hampshire for 18+ except for the city of Franklin, NH where it’s banned. The New Hampshire Kratom Consumer Protection Act passed the Senate and is pending. Advocacy by kratom consumers and the American Kratom Association kept it legal in the state.

✅ Kratom is legal in New York. KCPA 2023 pending.

✅  Kratom is legal in North Carolina 18+. KCPA bill filed and pending. North Carolina tried to ban kratom in 2016 but didn’t follow through.

✅ Kratom is legal in Ohio. KCPA bill pending 2023. Ohio Board of Pharmacy tried to schedule kratom as a controlled substance in the past but the American Kratom Association fought against it and they withdrew their proposal.

✅ Kratom is legal in South Carolina. South Carolina tried to ban kratom in 2023 but the bill expired in session. The only way a ban can happen is if an amendment is added to another bill.

✅ Kratom is legal in South Dakota. South Dakota tried to ban kratom in the past but the legislature rejected the bans and is now considering the KCPA.

✅  Kratom is legal in Tennessee 21+ with proper labeling. Tennessee tried to ban kratom in the past but the State Attorney General ruled it only applies to synthetic kratom. There was a KCPA bill 2023 but was killed in the Senate Judiciary Committee by the Chairman.
